Enquiq is a software service operated by Vithitech Services. By creating an account or using Enquiq, you ("you," "your business") agree to these Terms of Service. If you do not agree, do not use the service.
1. Account registration
You must provide accurate business information when registering for Enquiq, and are responsible for keeping your account credentials secure.
2. Business and customer responsibilities
You are responsible for the accuracy of the menus, services, prices and messages you configure in Enquiq, and for how you communicate with your customers through it. You are responsible for obtaining any consent required to message your customers.
3. Acceptable use
You agree not to use Enquiq to send unsolicited bulk messages, to violate Meta's WhatsApp Business Messaging Policy, to collect or process customer data unlawfully, or to use the platform for any illegal purpose.
4. WhatsApp usage & messaging responsibilities
Use of Enquiq is subject to Meta's WhatsApp Business Platform terms and policies, in addition to these Terms. We may suspend or limit messaging functionality if required to remain compliant with Meta's policies, or if your use of Enquiq risks the standing of our WhatsApp Business Platform access.
5. Customer data
You are responsible for the customer data you collect and store through Enquiq, and for complying with applicable data protection law in how you use it. Our handling of that data as a processor/service provider is described in our Privacy Policy.
6. Payments & subscriptions
Pricing and subscription terms, where applicable, are arranged directly with Vithitech Services and are not published or committed to on this website. No payment obligation is created by use of this website alone.
7. Service availability
We aim to keep Enquiq available and reliable, but do not guarantee uninterrupted availability, including of third-party infrastructure such as the WhatsApp Business Platform.
8. Intellectual property
Enquiq, its branding, and its underlying software are the property of Vithitech Services. You retain ownership of your own business content (menus, service definitions, customer data) entered into Enquiq.
9. Termination
Either party may terminate an account as described in your agreement with Vithitech Services. We may suspend or terminate accounts that violate these Terms or applicable law.
10. Limitation of liability
Enquiq is provided "as is." To the maximum extent permitted by law, Vithitech Services is not liable for indirect, incidental, or consequential damages arising from use of the service, including message delivery failures caused by third-party platforms such as the WhatsApp Business Platform.
11. Governing law
These Terms are governed by the laws of India, without regard to conflict-of-law principles.
12. Changes to these terms
We may update these Terms from time to time. Continued use of Enquiq after changes take effect constitutes acceptance of the revised Terms.
